There are no fees charged by Hi Point Steakhouse to use the Site, but there may be data usage or other like fees owed to your mobile carrier resulting from such use, for which you are responsible, and you are responsible for payment of any items purchased through the Site.

All text, graphics, images, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such Content, contained on this Site is owned, controlled or licensed by or to us, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws.

Hi Point Steakhouse has partnered with a third-party platform in order to allow online ordering for pickup (“Third Party”) Therefore, in addition to the Terms of Use, you are also agreeing to the terms of use that are required by the Third Party when you access the Third Party’s website.

In addition to other prohibitions as set forth in the Terms of Use, you are prohibited from using this Site and Content:

• for any unlawful purpose.
• to solicit the performance of any illegal activity or other activity which infringes the rights of Hi Point Steakhouse or others;

This Site and any information provided from it and these Terms of Use are given and made in Wisconsin, U.S.A. This Agreement is subject to Wisconsin law, without regard to its choice of law provisions, and suit, if any, must be brought exclusively within the courts of the State of Wisconsin, Dane County. You agree to submit to the jurisdiction of the courts located in the State of Wisconsin.

These Terms, together with the Privacy Policy, are the entire agreement between you and us relating to the subject matter herein and supersede any prior agreements between you and Hi Point Steakhouse.

If any provision of these Terms shall be unlawful, void, or unenforceable for any reason, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions.

No agency, partnership, joint venture, or employment is created as a result of these Terms, and you do not have any authority of any kind to bind us in any respect whatsoever.

Hi Point Steakhouse may assign its rights and obligations under these Terms, and these Terms will inure to the benefit of our successors, assigns, and licensees.

The failure of us to insist upon or enforce the strict performance with respect to any provision of these Terms, or to exercise any right under the Terms, will not be construed as a waiver or relinquishment to any extent of our right to assert or rely upon any such provision or right in that or any other instance; rather, the same will be and remain in full force and effect.

These Terms may be modified by our posting of changes to these Terms on the Site, or by written agreement of both parties. Each time you access the Site, you will be deemed to have accepted any such changes.
